End User License Agreement

1. Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Daeyla LLC ("Licensor") for the use of NCLEX Simulator ("the Application"). By installing, accessing, or using the Application, you agree to be bound by the terms of this EULA. If you do not agree, do not use the Application.

2. License Grant

The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial educational purposes, subject to the terms of this EULA and any applicable subscription plan.

3. License Restrictions

You may not: copy, modify, or distribute the Application or its content; reverse engineer, decompile, or disassemble the Application; rent, lease, lend, sell, or sublicense the Application; use the Application to develop a competing product; share your account or login credentials with any other person; use screen recording, screenshots, or any method to capture and redistribute question content; circumvent the Application's security features, lockdown mode, or access controls; use automated tools, bots, or scripts to interact with the Application.

4. Intellectual Property

The Application and all its content, including but not limited to question banks, rationales, case studies, EHR data, algorithms, user interface designs, and branding, are the exclusive property of Daeyla LLC and are protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any ownership rights in the Application.

5. Content Disclaimer

The Application is an educational simulation tool designed for NCLEX-RN exam preparation. It is not a substitute for formal nursing education, clinical training, or professional guidance. The Licensor does not guarantee that use of the Application will result in passing the NCLEX-RN examination. All clinical scenarios, patient data, and medical information in the Application are fictional and created solely for simulation purposes. Do not use any content from the Application for actual patient care.

6. Subscription and In-App Purchases

Certain features require a paid subscription. Subscriptions are managed through Stripe (web) or Apple In-App Purchase (iOS). Payment terms, renewal, and cancellation are governed by the applicable payment processor's terms and our Terms of Service. The Licensor reserves the right to modify pricing with reasonable notice.

7. Account Termination

The Licensor may suspend or terminate your account if you violate this EULA, including but not limited to: sharing account credentials, attempting to extract question content, circumventing security measures, or using the Application for unauthorized commercial purposes. Upon termination, your license to use the Application is immediately revoked.

8. Privacy

Your use of the Application is subject to our Privacy Policy, available at nclexsimulator.com/privacy. By using the Application, you consent to the collection and use of your data as described in the Privacy Policy.

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAEYLA LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. THE LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Updates

The Licensor may release updates to the Application from time to time. Some updates may be required for continued use. This EULA applies to all updates unless a separate EULA is provided with the update.

12. Governing Law

This EULA is governed by the laws of the State of Alaska, United States, without regard to conflict of law provisions.

13. Entire Agreement

This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and the Licensor regarding the Application and supersedes all prior agreements.
