Terms of Service

1. Acceptance of Terms

By accessing or using NCLEX Simulator ("the Service"), operated by Daeyla LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

NCLEX Simulator is a computerized adaptive testing (CAT) simulation product designed to help nursing students prepare for the NCLEX-RN examination. The Service provides practice simulations, performance analytics, and exam readiness feedback. NCLEX Simulator is not affiliated with, endorsed by, or connected to the National Council of State Boards of Nursing (NCSBN), Pearson VUE, or any state board of nursing.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old to create an account.

4. Subscription Plans and Payment

The Service offers free and paid subscription tiers. Paid plans are billed as described at the time of purchase. The Monthly plan renews automatically until cancelled. The Exam Week and 6-Month plans are one-time purchases for the stated duration. All prices are in US dollars. Payments are processed through Stripe (web) or Apple In-App Purchase (iOS). You may cancel your subscription at any time through your account settings or the applicable app store.

5. Simulation Attempts

Each subscription tier includes a limited number of simulation attempts per billing period. Attempts are consumed when an exam session is created, including sessions that are terminated early due to lockdown violations or manual ending. Unused attempts do not roll over to the next billing period for the Monthly plan.

6. Refund Policy

If you are not satisfied with the Service, you may request a full refund within 7 days of your initial purchase by contacting us at info@nclexsimulator.com. Refunds after 7 days are handled on a case-by-case basis. Refunds for purchases made through Apple In-App Purchase are subject to Apple's refund policies.

7. Acceptable Use

You agree not to: share your account credentials with others; attempt to access another user's account or data; reverse engineer, decompile, or disassemble any part of the Service; use automated tools to scrape, copy, or download question content; reproduce, distribute, or sell any content from the Service; circumvent any access controls, paywalls, or security measures; use the Service for any illegal purpose.

8. Intellectual Property

All content in the Service, including question stems, answer options, rationales, case studies, EHR data, and the CAT algorithm, is the intellectual property of Daeyla LLC. You may not reproduce, distribute, or create derivative works from this content without written permission.

9. Disclaimer

NCLEX Simulator is an educational tool for exam preparation purposes only. We do not guarantee that using the Service will result in passing the NCLEX-RN examination. The Service does not constitute medical, nursing, or professional advice. All clinical content is for simulation purposes and should not be used for actual patient care decisions. The Service is provided "as is" without warranties of any kind, either express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, Daeyla LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability for any claim arising from these terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Account Deletion

You may delete your account at any time through the Settings screen in the app. Account deletion permanently removes your profile, simulation history, and all associated data. This action cannot be undone.

12. Modifications to Terms

We may update these Terms of Service from time to time. We will notify users of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the State of Alaska, United States. Any disputes shall be resolved in the courts of the State of Alaska.
